01-30-12 KPESA Bargaining Update

The team met Monday, January 30th, at the conference room in the 4-D building.
We appreciate the support of the members attending: Lauri Weaver, Lennie Yoter, Katie Carmody, Debbie Harris, Richard and Kellie Kelso and the several others who dropped by during the extended caucus to lend their support.
The food and goodies from Cathy Carrow, Emily Nicholson, Lennie Yoter, and Sue Biggs, was also appreciated. * My apologies if I left anyone out.
Bargaining began at 3:00 pm with the district.

The teachers started the conversation with the district.
Terri started discussing KPESA Articles about 3:15 pm with the following Articles:Article 12 - Resignation in D: Terri asked "What happens to unused sick leave when an employee leaves?" District answer: "it goes back to the district general fund" Article 16 - Pay schedule: Terri asked "How will the $100 be paid; one lump sum or spread out over the year?" Also "Will 1 hr - 4 hr employees be paid $100 or will it be prorated?" District answer: "I have no answer for you on that."

Article 18 - Leaves & Benefits: How many employees use a sub for 1 hour or less? We don't have a number for you because a lot of that happens in-house. Article 20 - Personal Leave: How many extra personal days are awarded to 215 - 216 day employees? Not sure - less than 20. Article 27 - Health Care: How many 4 hour employee's will this change affect? Those already in the bargaining unit will be grandfathered status.

Terri presented counter proposals to the district on:

Article 2 - Definitions: Association wants an employee to be an employee regardless if they are paid with grant money or general fund money.
Article 7 - Personnel Files: Associatiion wants 45 days in letter F to respond to the Superintendent's response to material in the Personnel Files.
Article 10 - Work Rules:
Letter C2: Changing Transfer language to include all transfer requests.

Letter E: To include a meeting with the superintendent upon employee's request, and retain the ability to return to employee’s original shift within 2 years of shift change.

Letter G: No employee would lose work calendar days.
Letter M: Adding the current regulation stating travel time to be paid at regular rate of pay including overtime when applicable.
Letter P: Removed reference of 2009-10 school year - cleaned up language

Letter U: Added new language that no support instructional staff is required to perform teaching duties without certified supervision.


Article 11 - Discipline & Discharge:
letter G: Go back to 30 days for the district to notify an employee of a complaint, otherwise it cannot be used as disciplinary action.
Article 13 - Reduction in Force:
Deleted A7 regarding a laid off employee being granted first priority on the sub list
Changed B2 regarding a laid off employee remain on the rehire list for 18 months.
Article 18 - Leaves and Benefits: addition of one annual day per year
Article 19 - Holidays: Deleting a floating holiday
Article 23 - Unpaid Leave of Absence: Change "leaves of 2 weeks or less" to "unpaid leave"

Caucus was called at 3:30 until 6:45 pm

The rest of the evening was dedicated to KPEA discussion.
